Any individual wishing to start a divorce (also called a domestic relations action) must file the correct papers with the circuit court according to specific rules. If you talk to people at your local county clerk’s office, they may advise you to have an attorney. The clerk will tell you that they cannot give you legal information. However, you can do your own uncontested divorce and it is quite simple actually. Most people who performed their own divorce would recommend it to their friends.

 

There are certain papers to be filed with the court to begin a divorce.

1. The Complaint or Petition

2. The Summons

3. And various other papers based on the particular situations of the individuals. (explained below)

 

Every divorce begins with a Plaintiff (you) filing a Complaint or petition; which asks the court to grant an order. For example, a Complaint may ask the Court to grant a divorce. The Defendant (your spouse) is the person whom the Complaint is filed against.

 

The Summons is a document that legally asks the person complained against to answer the Complaint. This must be delivered to that person in a way that gave them notice of the action against them. This is called "Service of Process".

 

If your Spouse agrees to the divorce and will sign the paperwork, this is called an “Agreed Divorce”. If your Spouse does nothing with the divorce papers and doesn’t sign them and doesn’t contest anything with a lawyer, but simply sits on his/her hands, this is called a Default Divorce. Either way is good. We can do your divorce if either of these two circumstances take place.
