Annulment Hype

You have probably heard about “Annulments” and how the process is supposed to simply make a marriage disappear like it never happened. But it is a little more complex than that. Before a person can file for an annulment, they often have to have a pretty solid ground for wanting to have their marriage annulled. Annulments are designed for specific and rare scenarios where a marriage wouldn't have been legally binding in the first place. Some frequent scenarios include:

  • Polygamy
  • Incest
  • Fraud
  • Insanity
  • Mentally Disabled
  • Impotence
  • Underage (no consent)
  • Marriage
  • Not Consummated
  • Incompetence
  • Duress

These grounds vary among the states and do not guarantee that the annulment will be granted. Also note that:

Cohabitation could prevent (or disqualify) someone from getting an annulment.

Being married only a short time is not grounds for an annulment. The duration of the marriage does not matter.

For Catholics: A marriage is not legally impacted by a canonical annulment received through the Catholic Church.

People think that annulments are easier to get than a divorce. The truth is that annulments are more difficult to get because they are much more narrowly defined than a divorce and the biggest downside to an annulment is that you will probably need a lawyer to get an annulment. An annulment may cost you $3,000 or more compared to a divorce done online, which could cost you just a few hundred dollars.

 

Marriage for the Purpose of Citizenship

We often see people having another misconception about marriages that occurred for the sole purpose of one spouse obtaining citizenship through the other. A marriage is still a legal marriage regardless of the intent. You would still be getting a divorce if you wanted to dissolve this type of marriage.

 

Annulment Qualifications
